REAL ESTATE LISTING LICENSING AGREEMENT: Drew Castelhano is the sole copyright holder and owner of all media created and distributed in accordance with this agreement. Drwe Castelhano issues a limited license for the Client to use the digital media supplied under this agreement in his/her RMLS listing and in other promotional materials intended to sell real property under their current contract with the property owner. The media issued under this agreement may NOT be transferred to subsequent listing agents or the property owner in the event that the property does not sell under the terms of the current exclusive listing agreement.

Any other use of the media and use by other firms is not permitted under this license. Such unpermitted use includes (but is not limited to) use by designers, stagers, architects, builders, vendors, and suppliers. Please refer any requesting party to Drew Castelhano for access to the images and licensing.

MEDIA: Drew Castelhano provides digital media delivered in JPG format only (still photos). Video will be delivered in MP4 file format. All media will be delivered via Tourbuzz or Dropbox

MEDIA MANIPULATION: Images, video, and other media provided and licensed by Drew Castelhano may not be adjusted or manipulated in any way. The use of filters, effects, metadata adjustments, or any other change to our media is in violation of this license agreement and an infringement on our copyright. The only permitted adjustment to our media is cropping and the addition of text/ graphics as needed for marketing functions.

DERIVATIVE WORKS: Media may not be altered or combined to create new or derivative works, such as videos, AI products, or other secondary products.

SHARING: Do not share the media with other firms (including designers, contractors, and vendors.) Please refer any interested party to Drew Castelhano for licensing and use of the images. (info@coastalrephoto.com) Media may not be used as training material for AI platforms, LLMs, or other Digital Image training and recognition software.

CO-LISTING: This license extends to other agents within your local office (within your brokerage/firm) as co-listing agents. This license does not extend to other firms and their agents. If co-listing with another firm, each firm must purchase a license to use the images for the promotion of the property. Please direct other agents to info@drewcastelhano.com for details.

USE BY OTHER BROKERS/AGENTS: Your license covers your/ your broker's use of the images to promote the listing for sale. This does not include use by other agents on their social media channels etc. All requests for use by other parties must be directed to Drew Castelhano, info@drewcastelhano.com

COPYRIGHT: It is ILLEGAL to copy or reproduce the photographs, videos, website content, etc. issued under this agreement without Drew Castelhano’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. This agreement incorporates the entire understanding of the parties and is governed by the laws of SC. Any modification of this agreement must be in writing and signed by both parties.

AMENITY PHOTOS: Any amenity photos licensed under this agreement are limited to use for the specific listing for which they were purchased and are governed by the terms of this agreement. They may not be used for subsequent listings without an additional license. Additional fees may apply.

MULTIFAMILY and MODEL HOMES: My pricing is based on a single license for the one-time sale/rental of a single listing/unit. All photography for the rental or sale of multiple units requires a custom quote and license for such use. Please indicate your needs in your order notes. Additional licensing with fees is required for use of the images to promote more than one residence for sale.

IMAGE CREATION AND SELECTION: Drew Castelhano aims to create attractive images that assist in your goal of bringing a ready, willing, and able buyer to your client. The manner of creation, image selection, editing technique, and all decision-making in the creation of the images are at the sole discretion of Drew Castelhano. Drew Castelhano will not be held responsible for any compositions CLIENT deems "missing". Please indicate any "must-have" shots to the photographer or in the booking notes.

CANCELLATION & RESCHEDULING: I require a 24-hour notice of a change in schedule, or a $100 cancellation fee may be charged. I understand that the weather can change quickly. Weather-related postponements will not incur a rescheduling fee. Note that this refers to rescheduling an entire shoot due to bad weather. I am unable to split a photoshoot up into 2 or more trips without accounting for our time with additional fees. A second trip fee will be applied for any additional trips to the property.

SPECIAL ACCESS COMMUNITIES: Seabrook, Kiawah Island, Dunes West, Wild Dunes, and other gated communities will be charged additional fees, which account for gate passes and other expenses related to accessing the community.

TRAVEL: Regions covered include Charleston and the Tri-County areas. An extra 'Travel Charge' may be required for shoots outside the Charleston area. For more information, please get in touch with us info@drewcastelhano.com

PAYMENTS: Your card will be charged 50% at the time of your booking confirmation. Additional fees (ie. travel, additional approved services) will be processed to your card upon approval. By providing this information, you certify that you are the card owner or have the authorization to use this card. Additionally, you authorize Drew Castelhano to charge the card for the rendered services. Your card will be charged immediately upon confirmation.
Whole fees are due prior to the completion of work. By booking this service, you agree to allow us to charge your payment method on file prior to or upon completion of the rendered services.
